R. v. R. (R.), 2016 CarswellOnt 8528, 2016 ONCJ 307 (Ont. C.J.), Crewe Prov. Ct. J.: The accused was 16 years old at the time of the offence and 18 years old at the time of his guilty plea to dangerous driving causing death. He engaged in street racing with another driver. As they approached an 18-year-old cyclist within the city, the accused was driving at 130 km/h and the other driver was driving at 99 km/h. The accused was going at least 81 km/h at impact. The accused, who had a beginner’s licence, remained at the scene though coaxed to flee by his co-accused. After the charge was laid but before his plea, he completed his first of year of university and performed 500 hours of community service. He was remorseful. The sentence imposed was 7 months open custody, to be followed by 3 1/2 months community supervision, 1 year probation, 100 hours of community supervision and a 5 year driving prohibition.
