The Defendants submit that in not permitting transcription of the Reasons for Decision for the summary judgment motion, Justice Wright committed a breach of natural justice because the parties have a fundamental right to have access to the Reasons for Decision.

Notwithstanding the agreement of the parties and the direction of the motions judge, the Defendants were changing the rules of engagement and ambushing the Plaintiff. Justice Wright put a stop to it. To borrow again from Shakespeare, the Defendants have been "hoist[ed] with their own petard."
